Family of man killed in horrific crash may file wrongful death suit

On Behalf of | Jul 15, 2011 | Wrongful Death

On 10:49 p.m. on July 12, a three-car collision occurred at Kennedy Boulevard and St. Pauls Avenue. A pedestrian was struck so hard by one of the cars that his body damaged a cast-iron drainpipe on the nearby building he was slammed into. His lifeless body then fell and was impaled on a spiked wrought-iron fence.

As he was carrying no identification, police sought the public’s help in identifying the victim of this violent wrongful death. Today, the man was identified as a Jersey City man whose parents live in Mumbai. They have contacted a Jersey City lawyer, who is making funeral arrangements and seeking visas to allow family members to come to the U.S. for that funeral.

According to the attorney, the family has not yet made a decision about whether to file a wrongful death lawsuit in regards to their son’s death. However, he did tell reporters that it seemed likely, considering the direction the accident investigation appears to be heading.

“We have to await the full investigation from police and take it from there,” said their attorney.

After the car accident, a 19-year-old man from Jersey City was cited for speeding, reckless driving and making an unsafe lane change. His vehicle has been identified as the one that fatally struck the pedestrian and another man.

That man’s 24-year-old brother, also of Jersey City, was driving one of the other cars in the crash. He was cited for speeding and careless driving after the accident. According to police, his car spun out of control, crossed into oncoming traffic and collided with the third vehicle, and SUV driven by a 30-year-old man from Bayonne.
