The Brooklyn Roasting Company issued the recall this month for 2.5 gallon bags of pasteurized cold brew concentrate after finding that room temperature storage could lead to the growth of Clostridium botulinum toxin formation.

The affected products were distributed between April 1 and June 20, and they include best by dates between June 3 and Sept. 30.

Botulism is a rare condition caused by a toxin that attacks the body’s nerves, which can be fatal.

Symptoms of foodborne botulism usually start 12 to 36 hours later and include trouble swallowing, dry mouth, blurred vision, drooping eyelids, upset stomach, trouble breathing and paralysis.

Anyone experiencing botulism symptoms is urged to go to the emergency room immediately.

If you or a loved one has suffered losses due to consuming this or any Brooklyn Roasting Company product, you may be entitled to compensation. To learn more, contact the trusted attorneys at Breslin and Breslin today.

Yes, the families of temporary, seasonal and staffing agency workers may have the option to pursue a wrongful death claim after a fatal workplace accident in New Jersey. Workers' compensation death benefits may provide the first source of financial support. However, some cases could also support a separate claim against a third party, such as a contractor, property owner, equipment manufacturer or another negligent company.

How could workers' compensation apply?

New Jersey workers' compensation law may provide death benefits to eligible dependents when a worker dies from a job related injury. Those benefits could help cover funeral expenses and provide ongoing financial support. In many situations, however, they may not provide the same types of damages that a wrongful death claim could allow.

This issue may also affect temporary workers. If a staffing agency placed your loved one with a host employer, the employment arrangement could influence who provided workers' compensation coverage and how responsibility gets evaluated. The details of the placement, control over the worksite and the cause of the accident may all play a role.

When could a third party face liability?

A separate wrongful death claim may exist if someone other than the employer contributed to the fatal accident. In New Jersey, that could include unsafe worksite conditions, defective equipment, negligent subcontractors or a property owner who failed to address a known hazard.

For example, a third party could include:

A contractor who ignored workplace safety requirements

An equipment manufacturer that sold a defective tool or machine

A property owner who failed to maintain reasonably safe premises

A driver or outside vendor whose negligence contributed to the fatal accident

The facts of the accident may determine whether one or more of these parties could share responsibility.

Why does the employment arrangement matter?

Staffing agency cases often involve more than one business. As a result, you may need to identify which company directed the worker's daily duties, controlled workplace safety and had the ability to reduce or correct hazards. Those details could affect both a workers' compensation claim and a potential wrongful death claim against a third party.

What New Jersey law applies?

One law that may apply is New Jersey's Wrongful Death Act. The statute allows certain family members to pursue a wrongful death claim when a person's death results from a wrongful act, neglect or default. It may become especially relevant when someone other than the employer contributed to the fatal workplace accident.

Looking closely at the facts may reveal additional options

Every workplace accident involves its own facts. If several companies played a role in the events leading to the fatal accident, getting the right legal advice, a careful review of the worksite, safety records, contracts and witness accounts may help identify the legal options that could be available. Early action may also help preserve important evidence before it becomes more difficult to obtain.

For many families, workers' compensation may provide one path after a fatal workplace accident. Still, it may not always represent the only option. When another party's negligence may have contributed to the loss, a wrongful death claim could also be available under New Jersey law.

Because of the errors on these labels, owners could inadvertently overload the vehicle beyond what it has been designed to hold. This can make it much more dangerous to drive and increases the risk of that driver being involved in an accident.

The recall affects a range of different models from Subaru. These include the 2019 to 2026 Ascent, the 2025 to 2026 Forester, the 2025 to 2026 Forester Hybrid and the 2026 Crosstrek Hybrid.

For its part, Subaru has acknowledged the error, but so far claims that it does not know of any accidents specifically caused by these labeling mistakes.

Labels can be a product defect

This case helps to demonstrate how labeling errors can trigger product defect claims. This is something often referenced in regard to drugs and medications. Inaccurate instructions on the label could inadvertently cause someone to overdose, for example.

But as the Subaru case demonstrates, proper labels are important on all consumer products. Owners need to know the accurate statistics for their vehicles so that they can use them safely, or they could be put at risk.

Seeking financial compensation

Auto accidents can happen for a wide variety of reasons, including labeling errors made by the manufacturer. In cases like this, it is important for parties involved to understand exactly what legal steps they can take while seeking appropriate compensation.

According to documents associated with the recall, water can get into the rearview camera assembly, causing the printed circuit board (PCB) to corrode, which prevents the car from displaying the rearview camera image. According to NHTSA, the recall covers a subset of 2018–2022 Odyssey vans.

While the recall population is fairly large, the associated documents show that the number of cars affected should actually be relatively small. According to the paperwork filed with NHTSA, an estimated 0.8 percent of the total recall population (2604 cars) is expected to be defective.

The new recall, filed July 1, 2026, follows a previous recall filed in July, 2020, which handled Odyssey vans equipped with Magna rearview cameras. The affected vans left the factory equipped with Magna rearview cameras, which were then replaced with newer Magna units under the 2020 recall. According to the NHTSA documents, the vans covered under the newer recall will have their Magna units replaced with Sony rearview cameras instead.

Once the deadline elapses, your ability to seek compensation may disappear regardless of the merits of your case. Understanding the applicable deadline in your case is an important step toward pursuing the accountability and financial recovery you may deserve.

New Jersey’s statute of limitations

In most New Jersey personal injury cases, the statute of limitations is generally two years from the date of the accident to file a lawsuit. This legal deadline, known as the statute of limitations, applies to claims arising from car accidents, defective products, slip-and-fall incidents and other negligence-related injuries.

It’s also important to understand that preserving your right to file a lawsuit does not necessarily mean you will end up in court. Many personal injury claims are resolved through settlement negotiations without a trial ever taking place.

That said, maintaining the option to file a lawsuit can give you valuable leverage during settlement negotiations. When the at-fault party or their insurance company knows that you still have the legal ability to take your case to court, they may have a stronger incentive to negotiate in good faith. Once the statute of limitations expires, that leverage can disappear, and they may have little reason to offer a fair settlement.

Some exceptions apply

Certain circumstances can affect filing deadlines. For example, claims involving government entities, minors or victims unable to legally file a lawsuit on their own may have different deadlines. The same goes for injuries that are not immediately apparent.

Chlorthalidone tablets — which are used to treat high blood pressure — made by Inventia Healthcare Limited have been recalled after failing to meet dissolution specifications, which may cause them to work incorrectly.

Dissolution testing measures how well a drug releases into the body. If a medication fails this testing, it may not provide the prescribed dosage.

A total of 11,460 bottles of chlorthalidone tablets have been recalled nationwide.

All recalled tablets are 25 milligrams, in both 100-tablet bottles and 1,000-tablet bottles. Affected batches are RISA24001 and RISB24002.

Medicines that have been recalled have an expiration date of April 2027.

If you or a loved one has suffered losses due to ingesting this or any Inventia Healthcare Limited medication, you may be entitled to compensation. To learn more, contact Breslin and Breslin today.
